Overview

Welcome to Match Ready Tennis.

The terms “Match Ready Tennis”, “we”, “us” and “our” refer to Match Ready Tennis. We operate this website and online store, including all related information, content, features, tools, products and services offered through it.

Our online store is hosted by Shopify, which provides the ecommerce platform that enables us to offer products and services to customers.

These Terms of Service, together with any policies referred to in them, explain the rights and responsibilities that apply when you access our website, create an account, submit an enquiry, purchase a product or book a service.

Please read these Terms carefully before using the website or placing an order.

By accessing, browsing or using the website, or purchasing a product or service from Match Ready Tennis, you agree to these Terms of Service and our related policies, including our Privacy Policy, Shipping Policy and Return and Refund Policy.

If you do not agree with these Terms, you should not use the website or purchase products or services through our online store.

Nothing in these Terms excludes, restricts or modifies any rights, guarantees or remedies available to you under the Australian Consumer Law or any other law that cannot legally be excluded, restricted or modified.

Section 1 — Access, Eligibility and Accounts

You must be at least 18 years old to create an account or place an order independently.

If you are under 18 years old, you may only use the website or place an order with the involvement and permission of a parent or legal guardian.

When creating an account, submitting an enquiry or placing an order, you may be required to provide information including your name, email address, telephone number, billing details, delivery address and payment information.

You agree that all information you provide will be accurate, current and complete.

You are responsible for maintaining the confidentiality and security of your account credentials. You are also responsible for activities carried out through your account unless the activity occurred because of a security failure for which Match Ready Tennis is legally responsible.

String and tension recommendations
Racquet customisation services when available

We make reasonable efforts to ensure that product photographs, descriptions, specifications, prices and availability are accurate.

However, colours and product appearance may vary slightly because of photography, lighting, screen settings and the device used to view the website.

Product photographs may be representative. Packaging, graphics, colours or minor cosmetic details may change where a manufacturer updates a product without materially changing its identity or performance.

Published racquet specifications are generally based on information supplied by the manufacturer. Individual racquets may vary within ordinary manufacturing tolerances, including variations in weight, balance, swingweight and cosmetic finish.

Unless a particular measured specification has been expressly agreed with us before purchase, published specifications should be treated as nominal manufacturer specifications rather than guaranteed measurements for the individual racquet supplied.

We may update product information, remove products, discontinue products, introduce new products or limit available quantities where reasonably necessary.

Nothing in this section excludes any requirement that a product match its description or comply with applicable consumer guarantees.

Section 3 — Product Availability

All products and services are subject to availability.

Adding an item to your shopping cart does not reserve that item.

Stock levels displayed on the website may occasionally be incorrect because of simultaneous orders, inventory errors, damaged stock, supplier changes or technical issues.

If a product becomes unavailable after you place an order, we will contact you as soon as reasonably possible.

Depending on the circumstances, we may offer:

A suitable alternative
A revised timeframe
Removal of the unavailable item from the order
Cancellation of the affected item
A refund of the amount paid for the affected item

We are not required to supply an alternative product that you have not agreed to accept.

An automated order confirmation acknowledges that we have received your order. It does not necessarily confirm that every item or requested service can be fulfilled.

An order is accepted once:

Any necessary clarification regarding stringing or customisation has been resolved

We may contact you before fulfilling an order where information is missing, unclear or inconsistent.

We may decline or cancel an order where there is a legitimate reason, including:

A product is unavailable
A requested string, gauge, grip size or option is unavailable
Product or pricing information contains a genuine error
Payment cannot be processed
The order appears fraudulent or unauthorised
Delivery is unavailable to the nominated address
The requested service cannot reasonably or safely be performed
The order breaches these Terms or another applicable policy

If we cancel an order after payment has been received, we will refund the affected amount to the original payment method.

We may limit quantities where reasonably necessary to manage stock, prevent suspected resale abuse or ensure fair product availability.

Wholesale or commercial resale enquiries should be discussed with us separately before placing an order.

Section 5 — Reviewing Your Order

You are responsible for reviewing your order carefully before submitting it.

Please contact us promptly if you notice an error after placing your order.

We will make reasonable efforts to accommodate a requested change before processing begins, but changes cannot be guaranteed once an order has been accepted, packed, dispatched, strung or customised.

Section 6 — Racquet Stringing

Some racquets may be available unstrung or with an optional professional stringing upgrade.

The base product price shown on the website may represent the unstrung racquet unless the product page expressly states otherwise.

Where professional stringing is selected, the additional cost of the chosen string or service will be displayed before checkout.

Customers are responsible for confirming their selected:

String
Gauge
Tension
Full-bed or hybrid configuration
Main and cross strings for a hybrid
Main and cross tensions for a hybrid
Any other relevant setup instructions

If no tension is selected, or if the instructions are incomplete or unclear, we may contact you before commencing work.

We will not intentionally substitute a selected string or materially change a requested setup without contacting you, unless you have expressly authorised us to choose an appropriate alternative.

Once stringing has commenced, an order cannot ordinarily be changed or cancelled because of a change of mind.

If Match Ready Tennis makes an error in carrying out the agreed stringing instructions, please contact us promptly so the issue can be assessed and an appropriate remedy provided.

Section 7 — String and Tension Recommendations

Match Ready Tennis may provide recommendations relating to string type, gauge, tension, racquet setup or playing characteristics.

Recommendations are based on information available at the time, which may include:

Your racquet
Your playing level
Your playing style
Previous string setup
Preferred feel
Desired power, control or spin
Comfort requirements
String-breaking frequency
Information you provide about previous injuries or discomfort

Recommendations involve individual preference and cannot guarantee a particular playing result.

A string or tension that suits one player may not suit another player, even where their racquets or playing levels are similar.

String and equipment advice provided by Match Ready Tennis is general tennis-equipment guidance and is not medical advice.

If you experience pain, injury or ongoing discomfort, you should stop playing where appropriate and seek advice from a qualified healthcare professional.

Nothing in this section limits our obligation to provide services with due care and skill.

Section 8 — String Performance and Durability

String performance and durability vary according to numerous factors, including:

String construction
Gauge
Selected tension
Racquet head size
String pattern
Playing frequency
Playing style
Ball impact
Weather
Storage
Court surface
Frame condition
Contact with the ground or other objects

All tennis strings lose tension over time, including when a racquet is not being used.

Polyester strings may lose playing characteristics before physically breaking.

Multifilament, synthetic gut and natural gut strings may fray or show wear as part of normal use.

Natural gut is particularly sensitive to moisture, abrasion and improper storage.

Unless expressly agreed otherwise, Match Ready Tennis does not guarantee that a string will retain a particular tension, feel or performance for a specific period or number of playing hours.

This does not affect your rights where a stringing service has not been performed with due care and skill or where a supplied product fails to meet an applicable consumer guarantee.

Section 9 — Racquet Condition and Pre-Existing Damage

When providing a racquet for restringing, regripping or another service, you should disclose any known damage, repairs or concerns.

Before commencing work, we may inspect the racquet for visible issues such as:

Cracks
Structural damage
Collapsed or damaged grommets
Worn bumper guards
Damaged handles
Loose butt caps
Previous repairs
Distortion
Significant wear
Improperly installed components

Some damage may not be visible before existing strings, grips or other components are removed.

If we identify a concern that may affect the safety or suitability of the requested service, we may contact you before continuing.

We may decline to string or work on a racquet where we reasonably believe the frame or components are unsafe, unsuitable or at significant risk of failure.

Match Ready Tennis is not responsible for failure caused solely by an existing defect, ordinary wear, undisclosed damage or a structural problem that was not caused by our failure to exercise due care and skill.

Nothing in this section excludes responsibility for damage caused by our negligence or failure to provide a service with due care and skill.

Section 10 — Racquet Customisation

Racquet customisation services may include adjustments to:

Static weight
Balance
Swingweight
Twistweight
Grip size
Grip materials
Handle weight
Lead placement
Racquet matching
Other measurable setup characteristics

Customisation services will only be available where displayed or separately agreed.

Manufacturing tolerances, measuring equipment, materials and installation methods may result in small differences between target and final measurements.

Where a specific target specification is agreed, we will use reasonable care and appropriate equipment to achieve it as closely as reasonably practicable.

A customised racquet may feel or perform differently from its original factory configuration.

Customers should ensure that any requested target is suitable for their physical capabilities, playing style and intended use.

Once customisation work has commenced, the order cannot ordinarily be changed, cancelled or returned because of a change of mind.

Nothing in this section limits any consumer guarantee applying to the customisation service.

Section 11 — Prices

All prices displayed on the website are in Australian dollars unless expressly stated otherwise.

The total amount payable may include:

String upgrades
Customisation charges
Shipping charges
Other options selected by the customer

Any applicable charges will be displayed during checkout before the order is submitted.

Prices, promotions, discounts and availability may change without notice.

The price applicable to an order will generally be the price displayed when the order is submitted, subject to the correction of genuine errors.

Prices displayed on our website may differ from prices offered by other retailers, manufacturers, marketplaces or third-party stores.

We are not required to match another retailer’s price unless we expressly agree to do so.

Section 12 — Pricing Errors

We may cancel or correct a promotion where a genuine error has occurred, provided this is done consistently with applicable law.

Section 15 — Shipping and Delivery

Match Ready Tennis currently ships within Australia.

Available delivery methods, shipping charges and free-shipping thresholds are displayed at checkout and explained in our Shipping Policy.

Delivery timeframes are estimates and may vary depending on:

Professional stringing requirements
Events beyond our reasonable control

Racquets selected with professional stringing may require additional preparation before dispatch.

Tracking information will be provided where available.

You are responsible for supplying a complete and accurate delivery address.

Please contact us promptly if an address needs to be changed. We cannot guarantee that changes can be made after an order has been packed or dispatched.

Risk in the goods passes to you when the order is delivered to you, your nominated recipient or a location you have authorised for delivery.

If you authorise an unattended delivery or safe drop, you accept the ordinary risks associated with delivery to that nominated location, except where loss or damage results from a matter for which we remain legally responsible.

If an order is lost, damaged, incorrectly delivered or significantly delayed, contact us so we can investigate with the carrier and provide any remedy required by law.

Section 16 — Local Collection

Where local collection is offered, you must wait until we confirm that the order is ready before attending.

You may be asked to provide:

These exclusions apply only to change-of-mind requests.

They do not limit your rights where goods or services fail to comply with an applicable consumer guarantee.

Please contact us before returning an item. Products sent without prior contact may experience delays in assessment.

Section 18 — Australian Consumer Law

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law.

Goods must, among other applicable guarantees:

Match any sample or demonstration model where applicable

If goods or services fail to comply with an applicable consumer guarantee, you may be entitled to a repair, replacement, refund, cancellation, repeat performance or compensation, depending on the circumstances and whether the failure is major or minor.

Nothing in these Terms excludes, restricts or modifies those rights.

Section 19 — Intellectual Property

Unless otherwise stated, the website and its original content are owned by or licensed to Match Ready Tennis.

You retain ownership of your original content.

By submitting content to us or posting it in a location intended for public display, you grant Match Ready Tennis a non-exclusive, worldwide, royalty-free licence to reproduce, display, format and use that content for operating, promoting and improving the business.

This licence does not permit us to falsely change the substance of a customer review or represent feedback in a misleading way.

We may moderate or remove content where reasonably necessary because it is unlawful, irrelevant, abusive, fraudulent, misleading or in breach of these Terms.

Any purchase made through the Match Ready Tennis store is a transaction directly between you and Match Ready Tennis.

Shopify is not the seller of the products or racquet services offered by Match Ready Tennis.

To the extent permitted by law, Shopify is not responsible for fulfilling Match Ready Tennis orders, providing Match Ready Tennis services or resolving issues that relate solely to the products or services sold by Match Ready Tennis.

Nothing in this section limits any liability Shopify may have independently under applicable law or under its own agreement with you.

Section 32 — Limitation of Liability

Nothing in these Terms excludes, restricts or modifies liability where doing so would be unlawful.

This includes rights and remedies under the Australian Consumer Law.

To the maximum extent permitted by law, Match Ready Tennis will not be liable for indirect or consequential loss that:

Was not caused by our breach, negligence or unlawful conduct
Results solely from circumstances outside our reasonable control
Results from misuse of a product contrary to supplied instructions
Results from inaccurate or incomplete information provided by the customer

Where liability can legally be limited and it is fair and reasonable to do so, our liability may be limited to an appropriate remedy permitted under applicable law.

Nothing in these Terms excludes liability for fraud, wilful misconduct, negligence where liability cannot be excluded, or any other matter that cannot lawfully be excluded.

Section 33 — Customer Responsibility

You are responsible for using products in a safe and appropriate manner.

You should:

Stop using a racquet or accessory if damage is suspected
Follow manufacturer instructions
Avoid exposing equipment to unreasonable heat, moisture or impact
Select suitable equipment for your ability and physical circumstances
Obtain professional medical advice where injury or pain is involved

You are also responsible for the accuracy of any setup information or service instructions you provide.

This section does not transfer responsibility to you for defects, service errors or matters caused by Match Ready Tennis.

Section 34 — Indemnity

To the extent permitted by law, you agree to compensate Match Ready Tennis for reasonable loss arising from a third-party claim directly caused by:

Your fraudulent conduct
Your deliberate infringement of another person’s rights

This obligation does not apply to loss caused or contributed to by Match Ready Tennis, Shopify or another responsible party.

If fulfilment becomes impossible or unreasonably delayed, either party may have rights to cancel the affected portion of the order and receive an appropriate refund.

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be read down to the extent necessary to make it enforceable.

If it cannot be read down, the affected portion will be severed.

The remaining provisions will continue in effect.

Section 37 — Waiver

If we do not immediately enforce a right under these Terms, that does not mean the right has been waived.

A waiver will only apply where clearly communicated and will apply only to the particular circumstances for which it was given.
